Terms of Service

You must be at least 13 years old (or 16 in the EEA) to use AzelaAI. By using our services, you represent that you meet this age requirement. If you are using AzelaAI on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at info@azelaai.com if you suspect unauthorised access to your account.

• You may not create accounts using false information or impersonate another person.
• Each account is for a single user. Team and enterprise plans permit multiple seats as described in your plan.
• You are solely responsible for all activity that occurs under your account.

You agree not to use AzelaAI to:

• Generate content that is illegal, defamatory, harassing, threatening, or obscene
• Create or distribute malware, phishing content, spam, or deceptive material
• Infringe the intellectual property rights of any third party
• Attempt to reverse-engineer, scrape, or extract AI model weights or proprietary systems
• Conduct automated mass queries that exceed your plan limits or degrade platform performance for others
• Circumvent rate limits, access controls, or billing mechanisms
• Generate content that exploits or harms minors in any way
• Use the platform for activities regulated by HIPAA, PCI-DSS, or similar regimes without entering into an appropriate addendum with us

We reserve the right to suspend or terminate access without notice for violations of this section.

Our IP: AzelaAI, its interface, branding, proprietary software, model routing infrastructure, and all associated intellectual property are owned by AzelaAI and protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, or distribute our platform without written permission.

Your Content: You retain full ownership of the prompts, files, and content you submit to AzelaAI. By submitting content, you grant us a limited, non-exclusive licence to process it solely for the purpose of delivering the service to you.

AI Output: AI-generated responses are provided to you under the terms described in Section 5.

AzelaAI routes your prompts to third-party AI model providers (OpenAI, Anthropic, Google, Mistral, Meta, and others). The following apply to AI-generated content:

• No Warranty of Accuracy: AI-generated content may be inaccurate, outdated, or incomplete. AzelaAI is not responsible for decisions made based on AI output. Always verify AI responses from authoritative sources before acting on them.
• Ownership: To the extent AI-generated text is protectable by copyright, we assign any rights we may hold to you. However, the protectability of AI-generated content varies by jurisdiction.
• Third-Party Terms: AI outputs from specific models may also be subject to usage restrictions imposed by those model providers. You are responsible for complying with those terms.
• Professional Advice: AI output is never a substitute for qualified legal, medical, financial, or other professional advice.

AzelaAI offers Free, Pro, Premium, and Enterprise plans. Paid plans are billed in advance on a monthly or annual basis through Razorpay (cards, UPI, net banking, and wallets).

• Prices are displayed in the currency configured for your account region and are exclusive of applicable taxes.
• Your subscription automatically renews unless you cancel before the renewal date.
• Usage limits (messages, tokens, model access) are defined on the Pricing page and may change with notice.
• Overage charges, if applicable, are billed at the rate shown in your plan details.
• Annual plans are charged upfront and are non-refundable except as described in Section 7.

You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of your current billing period; you retain access until then.

Refunds: Monthly subscriptions are non-refundable after the billing date. Annual subscriptions may be refunded on a pro-rata basis within 14 days of the initial purchase or annual renewal. To request a refund, contact info@azelaai.com.

We reserve the right to refuse refunds if we have evidence of abuse, excessive chargebacks, or violations of these Terms.

We aim for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance, which we will communicate in advance where possible. Third-party AI model providers may experience outages outside our control, which may temporarily degrade or disable certain features.

We will not be liable for any loss or damages resulting from service interruptions beyond our reasonable control.

AzelaAI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The service will be error-free, uninterrupted, or secure
• AI-generated content will be accurate, complete, or reliable
• The service will meet your specific requirements

Important

To the maximum extent permitted by applicable law, AzelaAI and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the service.

Our total cumulative liability to you for any claim arising from these Terms or your use of AzelaAI shall not exceed the amount you paid to us in the 12 months preceding the claim, or USD $100, whichever is greater.

You agree to indemnify, defend, and hold harmless AzelaAI, its affiliates, officers, directors, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of AzelaAI in violation of these Terms
• Content you submit to the platform
• Your violation of any applicable law or third-party rights

We may suspend or terminate your account immediately, without notice or liability, if you breach these Terms or engage in conduct that we reasonably believe is harmful to AzelaAI, our users, or third parties.

You may terminate your account at any time from Settings → Account → Delete Account. Upon termination, your right to use the service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall continue to apply.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement.

You waive any right to participate in a class-action lawsuit or class-wide arbitration to the extent permitted by law.

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the platform at least 14 days before the new Terms take effect. Continued use of AzelaAI after the effective date constitutes your acceptance of the revised Terms.
